Last month, two Canadian Federation of Independent Grocers’ (CFIG) member stores received instructions from the Canadian Food Inspection Agency (CFIA) to provide nutritional and allergen labelling on products they had produced in-store.
Our retail members should be aware that back in 2007, CFIG obtained an exemption from the regulations governing labelling in this area. The exemption provides that for products produced in store, or in an off site commissary that is producing product for the one store (and not multiple store locations) then the exemption applies under regulation B.O1.401.(2)(v) FDR. This exemption saves retail grocers several thousands of dollars in direct and indirect costs annually.
CFIG intervened in Ottawa on behalf of the two member stores but also to safeguard an exemption that benefits all of our retail members. The CFIA in Ottawa has now indicated that our interpretation of the regulatory exemption is correct and indicated a written confirmation to that effect will be provided to us and to the Retail Council of Canada, since all grocers, even chains, benefit from the exemption.
When that confirmation is received, we will send out a copy to our members in our next update and post it on our website, so that it can be readily available in the event of any difficulties with a local CFIA inspector.
